Golf Cart Rental – Terms & Conditions

  1. Authorized Drivers

    Only drivers authorized in the rental agreement may operate the golf cart.

    The minimum driver age is 21 years old, and the driver must hold a valid driver’s license accepted in Costa Rica.

  2. Rental Use

    The golf cart may only be used for personal transportation within authorized areas in Costa Rica.

    The vehicle may not be subleased, transferred, or used for commercial purposes.

  3. Rental Period

    The rental period is specified in the rental agreement (Annex A).

    The vehicle must be returned no later than the agreed delivery date and time under the working hours from 9:00am to 4:00pm.

    Failure to return the vehicle properly to an authorized Sunset Club Carts representative may result in the vehicle being considered not returned or misappropriated.

  4. Vehicle Condition

    The renter acknowledges that the golf cart is delivered in good working and cosmetic condition, except for any marks or damages recorded at check-out.

    Electric golf carts must be returned fully charged.

  5. Passenger Capacity

    • 4-Passenger Cart: Maximum 4 passengers
    • 6-Passenger Cart: Maximum 6 passengers

    Passengers must remain seated with seat belts fastened at all times while the vehicle is in motion.

  6. Safety

    • No teenagers allowed to drive. Must be 21+ with a valid license
    • Children must remain properly seated with seat belts
    • Children may not ride on laps, stand, or ride outside the designated seats
    • No pets allowed

  7. Prohibited Use

    The golf cart may not be operated:

    • Under the influence of alcohol, drugs, or intoxicating substances
    • Without a valid driver’s license
    • In violation of Costa Rican traffic laws

    The vehicle may NOT be used for:

    • Off-road driving
    • Driving on beaches, sand, rivers, mud, or water areas
    • Towing or pushing other vehicles
    • Racing or speed competitions
    • Carrying loads exceeding the vehicle capacity
    • Transporting large or heavy equipment that exceeds vehicle limits

    The golf cart may only be used within the authorized perimeter established by Sunset Club Carts.

    Vehicles are equipped with GPS tracking. Failure to comply may result in immediate removal of the vehicle and a $500 penalty fee.

  8. Care and Responsibility

    • General damages
    • Loss
    • Theft
    • Misuse

    The renter must immediately notify Sunset Club Carts of any mechanical issue, damage, accident, or incident.

  9. Damages and Liability

    • Damage to the vehicle
    • Damage to third-party property
    • Injuries caused during the rental period
    • Traffic violations or tickets

    The renter must compensate Sunset Club Carts for replacement costs, loss of rental income, or other damages resulting from misuse or negligence.

  10. Security Deposit

    A security deposit of $500 USD is required at check-in per cart.

    The deposit may be used to cover:

    • Vehicle damages
    • Late returns
    • Cleaning or replacement costs
    • Traffic fines
    • Any unpaid rental fees

    Sunset Club Carts reserves the right to charge additional amounts exceeding the deposit if necessary.

  11. Accidents or Incidents

    • The renter must immediately notify Sunset Club Carts
    • When applicable, the renter must notify local authorities
    • The renter must cooperate with insurance or incident inspections

  12. Weather Conditions

    The renter acknowledges that operating the vehicle during severe weather conditions is at their own risk.

    Sunset Club Carts shall not be held responsible for weather conditions affecting the reservation or use of the vehicle, including storms, heavy rain, flooding, earthquakes, or other natural events.

  13. Right to Terminate Rental

    Sunset Club Carts reserves the right to terminate the rental agreement without refund if any terms are violated or unsafe operation is observed.

  14. Personal Property

    Sunset Club Carts is not responsible for lost, stolen, or forgotten personal items left in the vehicle.

  15. Jurisdiction

    This agreement is governed by the laws of the Republic of Costa Rica.
